General terms and conditions of CHEY photography Chamber of Commerce number 71639721
When booking a photoshoot, the client automatically agrees to the following conditions:
1. General
The photographer reserves the right to amend or supplement these terms and conditions. Amendments will be communicated to the client in writing and in a timely manner. If the client does not wish to accept a proposed amendment, they may terminate the agreement before the date the new terms and conditions take effect. The photographer reserves the right to change information regarding rates and agreements at any time.
2. Copyright
The copyright of the photographs remains with CHEY Photography at all times. The photographer always remains the owner of the photographs. The client must request written permission before submitting a photograph for competitions and publications by third parties. Any unauthorized use of the photographer's work will be considered an infringement of the photographer's copyright. In the event of infringement of the photographer's copyright, the photographer will charge the applicable SOFAM rates. Compensation does not entitle the client to further use the photographer's work.
3. Liability
The photographer is not liable for any damage incurred by the client, unless there is intent or gross negligence on the part of the photographer or their representatives. The photographer is not liable for color deviations on uncalibrated monitors or prints not provided by the photographer. Liability never exceeds the invoice amount.
4. Payment
When booking a photoshoot, the client must pay a deposit in advance. A payment request will be sent to the client for this. Once this payment is received, the date of the session is confirmed. Once the client has submitted their favorites in the online gallery, they will receive an invoice for the remaining balance.
If the client wishes to order additional photos after the session, payment must be made afterwards. The client will receive the photos after payment has been received. All prices quoted by CHEY Photography include VAT and exclude any travel expenses, unless otherwise stated.
5. Editing
Within 10 business days of the photoshoot, the unedited photos will be placed in an online gallery, where the client can view and select them in a smaller format. These are called contact photos. These contact photos are solely for selecting photos and may not be used or published in any way whatsoever. No unedited original photos (RAW files) will be provided.
6. Attribution
When using/publishing the photos by the client, for example on social media, the name or reference to the photographer must always be mentioned.
7. Complaints
If you have any complaints, please contact the photographer within 5 business days of receiving your photos. Refunds are not possible under any circumstances. If you are dissatisfied, we will explore how we can resolve the issue to your satisfaction, for example, by doing a new, shorter shoot.
8. Commercial and business purposes
When booking a photoshoot, the client consents to the use of the photos taken for business and commercial purposes (such as social media, websites, etc.). If the client does not wish to have a specific photo published online, this can be discussed with the photographer. If the client does not wish any photo to be published online, this must be communicated to the photographer prior to the photoshoot. The client is not permitted to share photos with a commercial company without the photographer's permission.
9. Cancellation
If the client cancels the appointment, the deposit will not be refunded. If the date of the shoot is rescheduled at the client's request, this must be done at least 48 hours in advance. If this is done less than 48 hours in advance, the deposit will not be refunded. This is to prevent no-shows.
In the event of inclement weather (storms, thunderstorms, or heavy rain), an outdoor photoshoot may be canceled in consultation with the photographer and client. This will be decided no later than the morning of the scheduled photoshoot. The photoshoot will be rescheduled to a new date. If the photographer is unable to conduct the photoshoot due to force majeure, a new appointment will be made as soon as possible. If this is not possible, the client is entitled to a full refund. The photoshoot and photos are personally created for the client, and therefore, refunds are non-refundable under no circumstances.
